KEY DEFINITIONS

“Operator” means a person who processes personal information for a Responsible Party in terms of a contract or mandate, without coming under the direct authority of that party;

“Personal Information” means information relating to an identifiable, living, natural person, and where it is applicable, an identifiable, existing juristic person, including, but not limited to—

1. information relating to the race, gender, sex, pregnancy, marital status, national, ethnic, or social origin, colour, sexual orientation, age, physical or mental health, well-being, disability, religion, conscience, belief, culture, language and birth of the person;
2. information relating to the education or the medical, financial, criminal or employment history of the person;
3. any identifying number, symbol, e-mail address, physical address, telephone number or other particular assignment to the person;
4. the blood type or any other biometric information of the person;
5. the personal opinions, views or preferences of the person
6. correspondence sent by the person that is implicitly or explicitly of a private or confidential nature or further correspondence that would reveal the contents of the original correspondence;
7. the views or opinions of another individual about the person; and
8. the name of the person if it appears with other personal information relating to the person or if the disclosure of the name itself would reveal information about the person;

“Processing” means any operation or activity or any set of operations, whether or not by automatic means, concerning personal information, including—

1. the collection, receipt, recording, organisation, collation, storage, updating or modification, retrieval, alteration, consultation or use;
2. dissemination by means of transmission, distribution or making available in any other form; or
3. merging, linking, as well as blocking, degradation, erasure or destruction of information;
“Responsible Party” means a public or private body or any other person which, alone or in conjunction with others, determines the purpose of and means for processing personal information;

DATA COLLECTION

Using our chatbot and WhatsApp channel, which is accessible by or via +27 (0) 77 456 6814, we collect personal data, including but not limited to your name, surname, cell phone number, vehicle enquiry details, and order history (hereinafter referred to as “your data”), to provide you with our services and enhance your experience.

PURPOSE OF DATA STORAGE

Your data will be stored and used for the following purposes:

• To communicate with you via WhatsApp for all enquiries regarding our products, services, and promotions.
• To send you marketing messages and updates that may be of interest to you.
• To manage and improve our loyalty programme and your experience with it.
• To improve our services and customer support.

REFUSING TO PROVIDE YOUR DATA

Should you refuse to provide your data to us, for any reason whatsoever, which you are entitled to do in terms of POPIA, please note that in doing so we may not be able to enhance our services to you, including all marketing activities, related discounts and the loyalty program.

DATA STORAGE AND SECURITY

Your data will be stored in a secure database. We ensure appropriate technical and organizational measures to protect your data against unauthorized access, alteration, disclosure, or destruction. Where we share your personal information with a third party, we conclude written contracts with the third party requiring them to implement and maintain the security measures necessary to protect the information. Your personal information will be processed in South Africa, and will not be transferred to a different country or international organisation.

COMPLIANCE WITH POPIA

We ensure compliance with POPIA by:

• Obtaining your clear, informed consent before collecting your data.
• Ensuring you have the right to access, add to, and correct your data shared with us.
• Implementing appropriate security measures to protect your data from unauthorized access, processing or breaches.
• Demonstrating accountability and governance in processing your data.

DATA SHARING

We will not share your data with any third parties, except as required by law or with your explicit prior consent.

DATA RETENTION

Your data will be retained for as long as necessary to fulfil the purposes outlined in this policy or as required by law. It will be used to track your spending to ensure you receive the loyalty benefits you are entitled to under the Klutch programme.

YOUR RIGHTS

At any given time, you have the right to:

• Request correction or deletion of your data.
• Withdraw your consent to us processing and/or storing your data at any time and in writing to us.
• Object to the processing of your data for marketing and/or any other purposes, bearing in mind that doing so may result in us being unable to enhance and/or properly provide our services to you and we will not be obliged to do so in such circumstance.
• Report any dissatisfaction with our processing of your data, or breach of your data, to the Information Regulator should you see fit.
